These Terms of Sale (“Conditions”) govern the purchase of products made through the website www.cavarell.com.

By placing an order through the Website, you confirm that you have read, understood and agreed to be bound by these Conditions together with our Privacy Policy, Terms of Service and applicable policies referenced herein.

If you do not agree with these Conditions, you must refrain from placing an order.

1. Scope of Application

These Conditions apply to all distance sales concluded between CAVARELL and customers purchasing products through the Website within the European Union, the United Kingdom and other supported delivery regions.

These Conditions apply exclusively to consumers purchasing for personal and non-commercial purposes.

2. Eligibility to Purchase

You may place an order if:

  • you are at least eighteen (18) years old or legally capable of entering into binding contracts under applicable law;

  • you provide valid and accurate personal and payment information;

  • purchases are made for personal use and not for resale or commercial distribution.

CAVARELL reserves the right to refuse orders suspected of commercial resale activity.

3. Ordering Process

To place an order, you must follow the online checkout procedure and submit your order by selecting the relevant confirmation button.

After submission:

  • you will receive an acknowledgement email confirming receipt of your order; and

  • a separate confirmation will be sent once the order has been accepted and prepared for shipment.

The acknowledgement email does not constitute acceptance of the order.

4. Formation of the Contract

A legally binding sales contract is formed only when CAVARELL confirms acceptance of your order through an order confirmation or shipping confirmation email.

Until such confirmation is issued, CAVARELL reserves the right to decline the order.

5. Product Availability

All products displayed on the Website are subject to availability.

If a product becomes unavailable after an order has been placed, CAVARELL may cancel the affected part of the order and refund any amounts paid for unavailable items without undue delay.

6. Order Cancellation Before Shipment

If you wish to cancel an order before shipment, you must contact customer support immediately.

Due to rapid order processing, cancellation cannot be guaranteed once preparation or shipment procedures have begun.

Your statutory withdrawal rights remain unaffected.

7. Refusal or Cancellation of Orders

CAVARELL reserves the right to refuse or cancel orders where reasonably justified, including but not limited to situations involving:

  • suspected fraud or unauthorized transactions;

  • incorrect or unverifiable payment information;

  • delivery restrictions;

  • pricing or technical errors;

  • breach of these Conditions;

  • suspected resale or commercial purchasing activity;

  • circumstances beyond reasonable control (force majeure).

Any payments received for cancelled orders will be refunded using the original payment method.

8. Prices

Product prices are displayed in Euro (€) unless otherwise stated and include applicable Value Added Tax (VAT) where required by law.

Shipping costs and applicable taxes are displayed during checkout prior to order confirmation.

Price changes do not affect confirmed orders.

In the event of an obvious pricing error, CAVARELL reserves the right to cancel the order and issue a refund.

9. Payment Methods

Payments may be made using payment methods made available during checkout, including credit cards, digital wallets or other approved payment solutions.

Payments are processed securely through third-party payment providers. CAVARELL does not store complete payment card information.

Fraud prevention checks may be conducted before order acceptance.

10. Promotional Codes and Gift Cards

Promotional codes:

  • are valid only during the indicated promotional period;

  • may be limited to single use;

  • cannot be exchanged for cash;

  • may not be combined unless expressly stated.

Where products purchased using promotional discounts are returned, refunds will reflect the discounted purchase value.

11. Delivery

Products will be delivered to the address specified during checkout.

Estimated delivery times are indicative only and may vary due to logistics providers, customs procedures or peak periods.

If delivery cannot be completed within thirty (30) days from contract formation, the customer may request cancellation and reimbursement.

Risk transfers to the customer upon delivery of the products.

Ownership of goods transfers only upon full payment.

12. Right of Withdrawal (EU & UK Consumers)

Consumers have the right to withdraw from the purchase within 14 days without providing any reason.

The withdrawal period expires 14 days after the day on which the customer, or a designated third party, receives the goods.

To exercise this right, the customer must notify CAVARELL of the decision to withdraw through a clear statement.

Effects of Withdrawal

Upon valid withdrawal:

  • all payments received, including standard delivery costs, will be refunded within 14 days;

  • reimbursement may be withheld until returned goods are received or proof of return is provided;

  • refunds will be issued using the original payment method.

Customers must return goods within 14 days after notifying withdrawal.

Returned products must be unused, unworn, complete and in original packaging.

Customers may be liable for diminished value resulting from handling beyond what is necessary to assess the product.

13. Non-Returnable Products

The right of withdrawal does not apply to:

  • personalized or custom-made products;

  • sealed goods unsuitable for return for hygiene reasons once opened;

  • products damaged through misuse.

14. Defective or Non-Conforming Products

Consumers benefit from statutory legal guarantees under applicable EU and UK consumer laws.

If products are defective or not in conformity with the contract, customers may request repair, replacement or refund in accordance with applicable legislation.

These statutory rights remain unaffected by these Conditions.

15. Exchanges

CAVARELL does not offer a product exchange service.

Products cannot be exchanged for alternative sizes, colors or models. Customers who wish to obtain a different item must exercise their right of withdrawal in accordance with Section 12 and return the original product for a refund, after which a new and separate order may be placed.

This policy does not affect statutory consumer rights relating to defective or non-conforming products under applicable consumer protection laws.

16. Liability

Nothing in these Conditions excludes or limits liability where such limitation is prohibited by law, including liability relating to death, personal injury, fraud or statutory consumer protections.

17. Applicable Law and Jurisdiction

These Conditions are governed by applicable laws of the European Union and, where relevant, the laws of the United Kingdom.

Consumers retain the right to bring proceedings before courts of their country of habitual residence in accordance with mandatory consumer protection legislation.
