Overview
These Terms of Service (“Terms”) govern your access to and use of the website www.cavarell.com, including all related content, features, tools, products and services made available through the website (collectively, the “Services”).
The Services are operated by CAVARELL (“CAVARELL”, “we”, “us”, or “our”).
By accessing, browsing or purchasing through our Services, you agree to be bound by these Terms. If you do not agree, you should refrain from using the Website.
Our online store is hosted by Shopify, which provides the e-commerce infrastructure enabling us to offer products and process transactions securely.
1. Scope of Application
These Terms apply to all users of the Website, including visitors, customers and any individual interacting with the Services.
These Terms are provided in English. Where translations are made available, the English version shall prevail in case of inconsistency, unless otherwise required under mandatory local law.
Additional policies published on the Website — including our Privacy Policy, Shipping Policy, and Returns & Refund Policy — form an integral part of these Terms.
In the event of conflict relating to consumer rights or personal data processing, the relevant policy shall prevail where required by applicable law.
2. Eligibility to Use the Services

You must notify us immediately of any suspected unauthorized access or security breach.
CAVARELL shall not be liable for losses arising from unauthorized account access resulting from the customer’s failure to maintain adequate credential security, except where such access results from a security breach attributable to CAVARELL.
CAVARELL reserves the right to suspend or permanently terminate customer accounts where misuse, fraud risk, policy abuse or violation of these Terms is identified.
CAVARELL reserves the right to deactivate dormant accounts for security or operational reasons.
5. Orders and Contract Formation
Product listings on the Website constitute an invitation to purchase and do not represent a binding offer.
When you place an order, you submit an offer to purchase the selected products. A legally binding sales contract is formed only once your order has been accepted by CAVARELL, typically confirmed through an order confirmation or dispatch notification.
We reserve the right to refuse or cancel orders where reasonably necessary, including in cases involving:
- product unavailability;
- payment authorization failure;
- suspected fraud or unauthorized resale;
- manifest pricing or listing errors;

CAVARELL reserves the right to correct operational, technical or administrative errors relating to pricing, product availability, order processing or system malfunction, including after an order has been submitted, where reasonably necessary and permitted under applicable law.
Where an order is cancelled after payment has been received, any paid amount will be refunded in accordance with applicable consumer protection laws.
You agree to provide current, complete and accurate billing, shipping and contact information for all purchases made through the Website.
Failure to provide accurate information may result in order delay, cancellation or delivery failure for which CAVARELL shall not be responsible.
CAVARELL reserves the right to refuse service, suspend transactions or cancel orders where reasonably necessary to protect against fraud, abuse, unauthorized resale, legal risk or violation of these Terms.
CAVARELL reserves the right to conduct fraud prevention and transaction verification checks prior to order acceptance or shipment.
Orders identified as presenting elevated fraud risk may be delayed, cancelled or made subject to additional identity or payment verification requirements.
CAVARELL shall not be bound by inaccuracies resulting from technical errors, system malfunction, typographical mistakes or unintended publication errors affecting product information, availability or pricing, to the extent permitted by applicable law.
Order confirmation emails acknowledge receipt of an order request only and do not constitute acceptance of the order.
5.1 Order Modifications and Cancellation Requests
Once an order has been placed, modification or cancellation requests may only be accommodated prior to processing or shipment and cannot be guaranteed.
After an order has entered fulfillment or has been dispatched, cancellation may no longer be possible and applicable return or withdrawal procedures shall apply.
Nothing in this section affects the consumer’s statutory right of withdrawal or return rights under applicable consumer protection law.
6. Product Presentation and Availability
We make reasonable efforts to ensure that product descriptions, images and pricing information are accurate.
However, variations may occur due to manufacturing processes, material characteristics or device display settings. Product images are provided for illustrative purposes only.
Minor variations in stitching, texture, colour tone or material characteristics shall not be considered defects where resulting from normal manufacturing processes.
Nothing in these Terms limits your statutory rights in relation to defective or non-conforming goods under applicable consumer legislation.
Customers acknowledge that purchasing decisions are made based solely on the product descriptions, specifications and information made available on the Website at the time of purchase.
CAVARELL shall not be bound by statements, representations or expectations arising from external sources, including social media content, third-party communications or promotional materials, unless expressly confirmed by CAVARELL in writing.
Customers are responsible for following any product care, handling or usage instructions provided with the product or on the Website.
CAVARELL shall not be responsible for damage resulting from improper use, handling, storage, washing or normal wear and tear occurring after delivery.
7. Pricing and Payments
All prices displayed on the Website are indicated in Euro (€) unless otherwise specified.
Prices may include or exclude applicable taxes, duties or value added tax (VAT) depending on the delivery destination and applicable legal requirements. Any applicable charges will be displayed during checkout before the order is confirmed.
CAVARELL reserves the right to modify prices, product availability or product specifications at any time prior to order acceptance.
Payments are processed securely through authorized third-party payment service providers. CAVARELL does not store full payment card details.
Currency conversion fees imposed by banks or payment providers remain the responsibility of the customer.
By submitting payment information, you represent and warrant that you are authorized to use the selected payment method.
Customers are responsible for reviewing all pricing details, applicable taxes, delivery charges and total order value prior to confirming a purchase.
Payment authorization may occur at the time an order is placed, while payment capture may occur upon order confirmation, shipment or shortly thereafter, depending on operational processing requirements.
8. Payment Disputes and Chargebacks
Customers agree to contact CAVARELL customer support and allow reasonable opportunity for resolution prior to initiating payment disputes or chargebacks with financial institutions or payment providers.
Initiating a chargeback without first attempting good-faith resolution may constitute breach of these Terms to the extent permitted under applicable law.
CAVARELL reserves the right to contest unjustified chargebacks and submit relevant transaction, delivery confirmation and communication records to payment service providers.
8.1 Transactional Integrity
CAVARELL maintains transaction monitoring and integrity safeguards designed to protect customers, payment systems and commercial operations against fraud, abuse and unauthorized activity.
Customers acknowledge that orders, payments, delivery interactions, return activity, communications and account behaviour may be assessed collectively for the purpose of verifying transactional legitimacy and compliance with these Terms.
Where reasonable indicators of fraudulent activity, abuse of policies, intentional misuse of withdrawal rights or commercially exploitative behaviour are identified, CAVARELL reserves the right, to the extent permitted under applicable law, to:
- delay or suspend order processing;
- request identity or delivery verification;
- restrict payment methods;
- refuse future transactions;
- limit return eligibility;
- suspend or terminate customer accounts.
Such measures are implemented solely for fraud prevention, security and operational integrity purposes and shall not affect mandatory consumer rights under applicable law.
8.2 Electronic Records and Evidence
Customers acknowledge and agree that electronic records generated through the Website, payment processors, logistics providers and related operational systems constitute valid and admissible evidence of transactions, communications and contractual performance.

Nothing in this section limits mandatory consumer rights or statutory evidentiary protections under applicable law.
9. Shipping and Delivery
Delivery options, estimated delivery times and shipping costs are presented during checkout and form part of the purchase contract.
Orders may be fulfilled in multiple shipments depending on product availability, logistics operations or warehouse location.
Delivery times may therefore vary between items forming part of the same order, without constituting partial non-performance of the purchase contract.
Estimated delivery times are indicative only and may vary due to logistics operations, customs procedures or circumstances beyond our reasonable control.
Delivery delays attributable to carriers, customs authorities or circumstances beyond CAVARELL’s reasonable control shall not constitute breach of contract or give rise to automatic cancellation or compensation rights, except where required under applicable consumer protection law.
Additional delivery conditions are described in our Shipping Policy, which forms an integral part of these Terms.
In the event of delivery-related disputes, the Shipping Policy shall govern logistical and delivery conditions to the extent permitted by applicable law.
Delivery services are performed by independent logistics providers. While CAVARELL selects reputable carriers, it does not control carrier operations once shipments have been transferred for delivery.
9.1. Delivery confirmation:
Delivery shall be considered completed when the shipment is delivered to the address provided by the customer at checkout, as confirmed by carrier tracking records or delivery confirmation systems.
Where delivery confirmation indicates successful delivery, responsibility for the goods transfers to the customer, unless loss results from circumstances attributable to CAVARELL.
9.2. Address Accuracy and Delivery Responsibility:
Customers are solely responsible for providing accurate, complete and accessible delivery information at checkout.
CAVARELL shall not be liable for delivery failure, delay or loss resulting from inaccurate, incomplete or inaccessible address information supplied by the customer.
9.3. Delivery Aftercare Responsibility:
Once delivery has been confirmed by the carrier, customers are responsible for ensuring secure receipt of the shipment at the designated delivery location.
CAVARELL shall not be liable for loss, theft or damage occurring after confirmed delivery, including situations where parcels are left at reception areas, mailrooms, concierge services or locations designated by the customer, except where required under applicable consumer protection law.
Delivery obligations shall be deemed fulfilled once goods are made available at the delivery address designated by the customer.
10. Transfer of Risk and Ownership
Risk relating to products purchased through the Website transfers to the customer or to a third party designated by the customer upon physical delivery of the goods.
Ownership of the goods transfers only once full payment has been successfully received.
Nothing in this section affects mandatory consumer protections applicable under European Union or United Kingdom law.
11. International Deliveries and Import Charges
Where products are shipped internationally, deliveries may be carried out under the Delivered At Place (DAP) / Delivered Duty Unpaid (DDU) regime, unless otherwise stated at checkout.
This means that import duties, VAT, customs clearance fees, brokerage charges or similar governmental fees imposed by the destination country are not included in product prices or shipping costs and remain the responsibility of the recipient.
Failure by the recipient to pay applicable import charges or to comply with customs clearance requirements may result in delivery delays, return of the shipment, or disposal of the goods by the carrier or customs authorities.
Where delivery failure results from recipient action or omission, any resulting costs may be deducted from refunds to the extent permitted under applicable consumer protection laws.
By placing an international order, the customer acknowledges and accepts responsibility for payment of all applicable import duties, taxes and customs charges required for delivery.
Customs clearance delays are outside CAVARELL’s control and shall not constitute grounds for cancellation while goods remain in transit.
12. Export/Trade Compliance
Customers agree to comply with all applicable import, export and sanctions laws applicable in their jurisdiction. CAVARELL reserves the right to refuse transactions prohibited under applicable trade or export regulations.
13. Consumer Rights and Right of Withdrawal
Consumers residing within the European Union or the United Kingdom benefit from statutory rights under applicable consumer protection legislation, including Directive 2011/83/EU on Consumer Rights and corresponding UK legislation.
Information regarding withdrawal rights, returns and refunds is provided in our Returns & Refund Policy, which forms an integral part of these Terms.
Returned products remain subject to inspection and verification upon receipt in order to confirm compliance with applicable return conditions prior to refund approval.
Nothing in these Terms limits or excludes mandatory consumer rights granted under applicable law.
Eligibility for refunds or returns is strictly subject to compliance with the conditions set out in the Returns & Refund Policy.
CAVARELL reserves the right, to the extent permitted under applicable consumer protection law, to refuse or restrict returns demonstrating patterns of excessive use, abuse of withdrawal rights or purchasing behaviour inconsistent with normal personal consumer use.
Statutory consumer rights applicable under national law remain fully applicable irrespective of any contractual provision contained in these Terms.
14. Intellectual Property Rights
All content available through the Website, including but not limited to trademarks, brand names, logos, product designs, images, texts, graphics, audiovisual materials, website layout, software elements and underlying source code, is the exclusive property of CAVARELL or its licensors and is protected under applicable intellectual property, copyright and trademark laws.

This restriction does not prevent lawful indexing performed exclusively for search engine discoverability.

To the fullest extent permitted by applicable law, CAVARELL shall not be liable for indirect, incidental or consequential damages arising from the use of, or inability to use, the Services.
This limitation does not apply where damage results from fraud, gross negligence, willful misconduct, personal injury, death, or any liability that cannot be excluded or limited under applicable law.
Consumer statutory rights remain unaffected.
Liability, where applicable, shall be limited to damages that are reasonably foreseeable at the time of contract formation.
To the extent permitted by applicable law, CAVARELL’s total liability arising from any claim relating to a purchase shall not exceed the amount paid by the customer for the relevant product giving rise to the claim.
22. Indemnification
You agree to indemnify and hold harmless CAVARELL, its directors, officers, employees, affiliates, contractors, service providers and partners from and against any claims, liabilities, damages, losses or expenses, including reasonable legal fees, arising from:

26.1. Commercial Framework and Contractual Integration
The contractual relationship between the customer and CAVARELL is formed through the combined application of these Terms together with all policies, notices and transactional information made available throughout the purchasing process.
This includes, where applicable:
- product descriptions and specifications displayed on the Website;
- pricing, delivery information and checkout summaries;
- Shipping Policy;
- Returns & Refund Policy;
- Privacy Policy;
- payment confirmations;
- order confirmation and dispatch communications;
- information presented during checkout prior to order completion.
Customers acknowledge that the purchase contract is concluded based on the commercial framework presented at the time of purchase and not on isolated statements or information taken out of context.
In the event of inconsistency, mandatory consumer protection laws shall prevail.

Customers agree to engage in good-faith efforts to resolve disputes informally for a reasonable period prior to initiating formal legal proceedings where permitted by applicable law.
